Even at first glance, the Forest Rights Act (FRA) would seem not only relevant but exceptionally so. Section 3(1)(j) would place customary rights on a far stronger footing by formally recording them and applying safeguards against arbitrary diversion. Further, community forest rights would allow communities to nullify the untenable declaration of forested community land as state forests. The FRA is, however, no silver bullet to all the issues around forest land in Arunachal Pradesh. Given the expansion of state-controlled forests, several old villages and even towns, including parts of Itanagar, technically stand on state forest land.
