Pitt is arguing it is a conflict for lawyer Fred Rabner to represent Antwon Rose II’s estate, which had previously sued East Pittsburgh, while the estate simultaneously pays for the borough to defend itself in court against a lawsuit by Pitt. She told the court that she has reviewed the issues in the estate case and wrote an opinion in which she found no conflict of interest. More than a year after the lawsuit was filed, Pitt sued East Pittsburgh and Rosfeld, as well. “In the present case, if liability exists, it rests solely with East Pittsburgh and Rosfeld,” Pitt’s attorneys wrote in the complaint against them. Bringing the borough on as a defendant triggered the clause in the federal court settlement for the estate to pay East Pittsburgh’s fees.
