FMCSA expected to propose stricter language for English proficiency

Currently, truckers who are unable to read road signs and communicate with law enforcement are triggering an out-of-service violation.
In late June, FMCSA submitted a proposed rule to the White House’s Office of Management and Budget about English proficiency and out-of-service orders.
This would be an important distinction as most regulations on FMCSA’s books don’t automatically require law enforcement to issue an out-of-service order.
Following an executive order from President Donald Trump in April 2025, CVSA voted in May 2025 to reinstate the out-of-service order and to shore up CDL testing standards.
Then in October 2025, CVSA petitioned FMCSA to amend 49 CFR 391.11(b)(2) to require an out-of-service order when drivers don’t meet English-proficiency standards.
