Kenyans buying the affordable housing units under the Affordable Housing Programme (AHP) could face a significantly shorter window to recover from loan defaults if proposed amendments to the Land Act are approved by Parliament. In Clauses 14 and 15 of the proposed bill, the statutory period before a lender can begin enforcing a loan secured by affordable housing property would be cut from 90 days to 45 days. The proposed shorter timelines would apply specifically to properties used for affordable housing, while the existing timelines for other categories of property would remain unchanged. We must interrogate whether the proposed timelines are fair, practical and in the public interest,” Nyamoko stated.
