The catch is that the county wants to impose this fine without a jury trial. The Kings demanded the department prove its claims. In response, the Ecology Department ridiculously asserts that it has not brought any claims whatsoever. Here, therefore, the Department of Ecology must prove its claims that the Kings (1) actually harmed wetlands and (2) should pay a penalty. Here, merely naming the Kings’ right to a hearing an “appeal” is irrelevant.
