The contested decisions were made on the basis of the Weapons Act, which allows the government to decide on the establishment or expansion of a training ground for the defense forces and the Kaitseliit (Defense League) volunteer corps on the proposal of the responsible minister and based on a risk assessment, without applying the Planning Act if the sole purpose of establishing or expanding the training ground is to ensure national defense and a delay in the planning procedure would increase the threat to national defense. The court does not doubt that a larger training area is needed in Southeast Estonia and that this need has been created by the changed security situation. However, the court found that the government's premise that the delay resulting namely from the implementation of the Planning Act increases the threat to national defense was unfounded. The court found that the government had sufficient time to process the expansion of the training ground in the form prescribed for that purpose -- as a national designated spatial plan. The court found that the expedited procedure prescribed in the Weapons Act was the result of a political choice.
