Tolko Industries was found to be responsible for a 2017 landslide that deposited 11,500 cubic metres of material into Rosemond Lake, located just south of Mara Lake.
In the decision, Lu noted that Tolko Industries became aware of the landslide a few days after it occurred, but never reported the incident to the province.
In its appeal, Tolko Industries didn't deny responsibility for the landslide, but instead argued the $75,000 fine handed down in the 2022 decision was excessive.
In the decision, Lu found the gravity of the contraventions to be “significant or high,” adding the evidence showed the contraventions were caused by Tolko’s “apparent oversights and lack of due diligence.”
