This development signals a shift in positioning, regarding the proposed merger, by CN. Following the April 30 submission of an amended merger application by UP for the proposed merger, CN filed comments in May with the STB, arguing that the application “still fails to meet the Board’s requirements and thus remains incomplete.” On May 28, in a unanimous decision, the STB accepted the revised major merger application filed by UP and NS for consideration, in addition to a related application. “Today, the Board finds that Applicants have provided sufficient information to satisfy the completeness requirements for a major merger application,” stated the STB.
