Lyman was accused of shaking the baby, causing his death, and in February, a Kansas court overturned the conviction.
“It was a difficult case for the state, for the plaintiff and for the victim’s family, who we were in contact with while the case was proceeding the second time,” Hutchison said.
In other business Tuesday, the State Finance Council approved a payout of $35,000 “as a settlement and compromise” in a case filed by the U.S. Department of Justice against the Kansas Department of Health and Environment.
In that case, Stacy Gonzales was employed by the Finney County Health Department in a position funded as part of a KDHE grant, according to court records.
The court ruled the health department, not KDHE, was Gonzales’ employer, but the case is currently being appealed.
