The Delhi High Court has clarified the scope of Section 104A of the Patents Act in F Hoffman-La Roche & Anr v Zydus Lifesciences. In such cases, the court may direct the defendant to prove that its process is different from the patented one. In February 2024, the court directed Roche to undertake a claim-mapping exercise comparing the product patent’s claims with Zydus’s patent application to assess potential infringement. The court also ordered Zydus to submit its manufacturing process in a sealed cover. While directing the defendant to disclose its process, the Court would protect the trade and commercial secrets of the defendant.
