The Administrative Review Tribunal has annulled a €10,000 fine issued to a tuna farm operator after it held that the notice which was served to the company informing it of the infringement and fine was not made according to the requirements of the law. Mare Blu Tuna Farm also disagreed with the findings from the inspection and argued that it was impossible to establish the amount of tuna in the pen, and the numbers could be reduced due to adverse weather conditions. Antonello Cappitta, the director of the tuna farm operator, testified that there were several factors that could lead to discrepancies between the amount of tuna that was originally caged and the amount of tuna found during a controlled transfer. During a controlled transfer, about 1,000 to 2,000 tuna fish are being transferred, so that counting them becomes difficult. Fish farm operators are informed 48 hours before that an inspection will take place, a senior manager at the fisheries department told the tribunal.
