By law, under the Local Government (Scotland) Act 1973, the committee must include three religious representatives. Currently, the committee has representatives from the Roman Catholic Church and the Church of Scotland, leaving a vacancy for a third religious representative. The position can be filled by a church or denominational body with a place of worship in East Lothian, or by an independent individual. Religious representatives, like union representatives, no longer have voting rights in the committee following a vote in December 2023. The role provides an opportunity for religious organisations or individuals to contribute to the development and review of policies affecting education and children's services in East Lothian.
