WINONA, Minn. — Adam Fravel’s attorney is asking for a new trial in the appeal of Fravel's 2024 conviction in the murder of Madeline Kingsbury.
The court allowed testimony on the incident from 10 of the witnesses.
Scanlan argued that the state offered the testimony without context and failed to meet standards under Minnesota court rules that allow hearsay testimony.
Scanlan argues the court erred in allowing Ross Zumwalt, a pathologist at Mayo Clinic, who performed Kingsbury's autopsy in June 2023, to offer his inference that Kingsbury’s death was intentional.
Scanlan also argues that abuse expert Melissa Scaia “spoke in vague generalities” in her testimony which was “not objective” and presented without context.
