The court stated that the club failed to renew its lease and continued to occupy the site without authorization. The court rejected those claims, finding the lease terms were clear and the DEP had provided the required 90-day notice to terminate. “The lease terms are undisputed and establish two distinct ways to find the [club] is currently a holdover tenant,” the court wrote. A request for comment from the Sunset Beach Sportsmen’s Club was not immediately returned.
