Vitalij Maceljuch, of no fixed abode, was found dead at the Thorncliffe site in Alltami, near Ewloe, on May 10. The court heard the driver said all the cardboard was flat and "nothing appeared disrupted" when he had checked them. The court heard that after another seven or eight stops, the lorry arrived at the Thorncliffe site just after 10am, and was emptied at the site, before leaving. Mr Maceljuch was discovered by workers not long after 11am and a call was then made to North Wales Police. The driver of the lorry, and workers at the Thorncliffe site were all cleared of any health and safety breaches, following a HSE investigation.
