So an Alaskan bush pilot walks into the Supreme Court with a six-pack of beer.
On remand, the trial court held that the forfeiture would constitute an unconstitutionally excessive fine.
The Alaskan Supreme Court then granted review and vacated the court of appeals’ judgment.
There appears to be a conflict between the interpretation of the Alaska Supreme Court and the United States Court of Appeals for the Ninth Circuit (with federal jurisdiction over Alaska).
The Institute was the group that won the decision in Timbs v. Indiana at the Supreme Court and twice at the Indiana Supreme Court.
