The county government originally authorized the zone change about six years ago but the decision has repeatedly been challenged by farmland preservation advocates who claim it adversely affects big game habitat. “We conclude that the county’s interpretation plausibly interprets the express, ambiguous text of the dwelling density standards,” according to the LUBA ruling. According to the LUBA decision, the density standards for building in the county’s big game habitat are ambiguous but the zone change relied on a permissible understanding of those rules. “We’ve got so much new information in terms of what wildlife habitat is, where wildlife habitat is, how it’d be better to protect it and the like. Yet that’s not being utilized in land use decisions because county plans have not been updated for years and years and years,” Johnson said.
