A local anti-shale group called Protect PT, backed with Big Green money and lawyers, appealed the decision to the state’s Commonwealth Court. CNX also appealed the EHB decision. While the lawsuit plays out, the original DEP permits in question have expired. The companyallowed them to expire so they could reapply for new permits.
