A grand jury voted not to file charges against state troopers in the custody death of a 38-year-old that was sought in a Warren County shooting in 2024, the state Attorney General’s office said. Avitable, of East Stroudsburg, Pennsylvania, died after suffering a medical episode while in police custody, was accused of shooting and killing Cheryl Schilling in her Knowlton home. After more than 10 minutes of struggling with officers, Avitable suddenly became unresponsive, video shows. He ended up in an argument with his friend and Schilling and chased the couple into an upstairs bedroom with a pump-action shotgun before shooting Schilling, officials have said. Avitable then fled the home and fired two more shots into the couple’s home before leaving the gun on the property.
