If these conditions apply, an application for the child's "Article 50 EUV family member" residence permit must be submitted within three months of their birth or adoption. The application must be submitted by the child's legal representative (parents or legal guardians) to the local settlement and residence authority, depending on the applicant's residence. If a child does not qualify for an Article 50 EUV permit, they may still be eligible for a residence permit under Austria’s Settlement and Residence Act (Niederlassungs- und Aufenthaltsgesetz – NAG).
