The Delhi High Court has ordered the cancellation of the trademark of footwear firm Croose, citing that it is “deceptively similar” to the American footwear company Crocs visually and phonetically.
Justice Tejas Karia, in an order dated September 26, issued the directive in a trademark suit filed by Crocs Inc., which sought the cancellation of the trademark registration of Croose.
In its petition, Crocs submitted that it was the “prior user and adopter of the said ‘CROCS’ marks”.
It said that it applied for trademark registration in India in 2005 and 2006.
