Following the ruling, the Equality and Human Rights Commission (EHRC) issued interim guidance relating to trans people’s use of facilities including changing rooms and toilets, and participation in sports. Earlier this month, delegates at the Trades Union Congress (TUC) unanimously voted to reject the court’s ruling and the guidance. The motion, which was carried at its annual conference in Brighton, declared that April’s Supreme Court ruling breached the European Court of Human Rights (ECHR). “It was absolutely correct that Anas Sarwar and Jackie Baillie, the leader and deputy leader of Scottish Labour, expressed their regret for support of the gender recognition reform bill in Scottish Parliament.”Ms Smith also said the Scottish Government was failing to act on the judgment.
