"The demand for Mr Spencer to attend the workplace during a period when he was recovering from a very traumatic injury resulting in a significant disability is offensive," Judge Strathdee said. "To treat any employee who was severely injured whilst working for the defendant, in such a way is disgraceful... To call him in and then give him a 'final warning' is heartless in the extreme."
