Recall the Federal High Court in Abuja, on Friday, dismissed the no-case submission filed by Nnamdi Kanu.
AdvertisementJustice James Omotosho, in a ruling, held that the Department of State Services had established a prima facie case against Kanu.
The organization cited Section 303(3) of the Administration of Criminal Justice Act (ACJA) 2015, which sets the test for determining a no-case submission.
The group also argued that Section 122 of the Evidence Act 2011 makes it mandatory for courts to take judicial notice of repealed laws.
The organization further maintained that the ruling disregarded Section 36 of the 1999 Constitution, which guarantees the right to a fair trial.
