Starodaj argued that Stony Run, the largest apartment complex in the city, is governed under the regulatory agreement reached between the city and Aker in April 2023. Aker has appealed the rent administrator’s July 2025 ruling“DHCR’s July 2025 order ignored how the city’s regulatory agreement restricts rents and rejected the petition for administrative review on standing grounds,” Starodaj argued. The city has also clashed with tenants’ rights advocates as to whether ETPA protections run with the unit or the tenant. Advocates say that when new tenants move into the complex, they do not have ETPA protections and therefore face much higher rents under the city’s regulatory agreement. “The regulatory agreement ensured that all current tenants kept their ETPA rights and that future tenancies would be governed by the agreement’s affordability plan for 40 years.”
