The Kerala High Court recently held that the constitution of an Internal Complaints Committee (ICC) by the Kollam Bar Association was against the objective and requirement of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [POSH Act]. Subsequently, a complaint was made to the Bar Association, which forwarded the same to an ICC constituted as per Section 4 of POSH Act. Noting that the Advocates Act does not make mention of Bar Associations, the same is given recognition and duties under the Kerala Advocates Welfare Fund Act, 1980.
