The Louisville, KY-IN Area was reclassified by operation of law from Marginal to Moderate nonattainment on October 7, 2022, following EPA's finding of failure to attain by the Marginal area attainment date.
On July 5, 2022, EPA finalized approval of the redesignation request and maintenance plan for the Indiana portion of the Louisville, KY-IN Area.
On September 6, 2022, KDAQ submitted a redesignation request and maintenance plan for the Kentucky portion of the Louisville, KY-IN Area.
As it relates to KDAQ's redesignation request, Region 4 is applying the same redesignation “criteria, procedures, and policies” that Region 5, and all other regions, follow.
Final ActionEPA is denying KDAQ's September 6, 2022 redesignation request because the Area has not met the first redesignation criterion.
