The Supreme Court of Appeal (SCA) has dismissed Pick n Pay’s final attempt to challenge liability in a long-running slip-and-fall case. The case was brought by Maria Williams, widow of late Springbok legend Chester Williams, following a fall at a Pick n Pay store in Cape Town in 2017. ADVERTISEMENTIn its ruling, the court confirmed that Pick n Pay had failed in its duty to provide reasonably safe premises for customers. While the retailer was found negligent, the court also upheld that its contracted cleaning company, Bluedot, remains contractually obliged to indemnify Pick n Pay for any damages that may be awarded.
