Hurlston‑Cruz admitted to charges of careless driving and DUI, but he was not charged with driving without insurance. Therefore, the sale was complete; Claxton no longer owned the vehicle and no longer had an insurance interest. An insurance policy is a contract of personal indemnity, and the insurer cannot be compelled to accept responsibility in respect of a third party who may be quite unknown to them.
