The violations cited by the state Department of Environmental Conservation are more extensive than previously disclosed this week when leaders of the Olympic authority and a DEC official revealed that work had happened without the necessary DEC work plan approval, itself a violation. That draft work plan submitted to DEC said that the race track would be built without tree-cutting and would take place within the footprint of existing trails. That is not what took place, according to a Sept. 22 notice of violation letter from the DEC regional director Joseph M. Zalewski. Instead of waiting for DEC approval of a work plan, for which DEC was asking for more details, ORDA pushed forward with building the race course, modifying the design during the process. It must map all constitutionally permitted trails within the forest preserve on ORDA-managed facilities (Belleayre in the Catskills, Gore near North Creek, Mount Van Hoevenberg near Lake Placid, and Whiteface in Wilmington).
